Coe Baxter Settles Wrongful Death Lawsuit in Tuscaloosa County, Alabama
Prince Glover Hayes partner, Coe Baxter, recently settled a wrongful death lawsuit for a substantial confidential amount. The deceased was killed when the defendant failed to yield the right-of-way and crashed into her car. The deceased had to be cut out of her car, taken by ambulance to the hospital and was in Intensive Care until her death.
Along with other types of personal injury, Prince Glover Hayes has extensive experience in successfully prosecuting wrongful death claims. Wrongful death describes the death resulting from a personal injury caused by the negligence or reckless action of another.
The Alabama Wrongful Death Statute is unique in that any money damages awarded are entirely punitive (designed to punish the wrongdoer), rather than compensatory. However, any recovery by the family (or other designated personal representative) can, of course, be used to compensate for lost income, lost future earnings and to offset expenses. On an emotional level, a wrongful death lawsuit brings not only justice, but also closure because the family knows steps have been taken to prevent others from experiencing a similar fate at the hands of those responsible.
