Josh Hayes, PGH partner, settled a car wreck case for a client who was injured when her car was struck by the adverse driver who turned in front of her. Josh’s client was badly injured and suffered a fracture of her lower end of right radius, a fracture of one rib on the right side and a contusion of the bilateral front wall of her thorax. Eventually, an orthopedic surgeon performed an open reduction with internal fixation of the right intra-articular distal radial fracture with four right limited open carpel tunnel release. Post surgery, the surgeon informed Josh’s client that she would have pain for six months to a year and added strength training to her physical therapy plan. That plan consisted of 21 outpatient physical therapy visits. In a detailed demand letter, Josh informed the adverse driver’s insurance carrier of all the medical treatment his client had endured and the expenses she had incurred. Medical records were submitted along with photographs of his client’s vehicle and her injuries. Through skillful negotiations with the adjuster, Josh was able to settle his client’s claim for the policy limits of $100,000.00 plus some additional proceeds from the client’s uninsured motorist coverage policy.
