Matt Glover PGH Partner, Settles Lawsuit Against Multiple Defendants for Confidential Amount

Matt Glover, Prince Glover Hayes partner, recently settled a lawsuit filed in Pickens County against multiple defendants.  Matt’s clients’ (the plaintiffs) home was totally destroyed by fire as they slept in the home with their two children.  The fire was reported to the insurance company and was assigned to an estimator.  The insurance company (one of the defendants) declared the home to be a “partial loss”.  However, Matt’s clients had hired their own independent contractor whose estimate exceeded the policy limit by almost $100,000, thereby evidencing a “total loss”.  To comply with one of the provisions in their policy to “protect property from further damage after loss and take reasonable and necessary measures required to protect the property”, the plaintiffs were specifically told they had to contact the insurance company’s “preferred vendor” for fire and smoke damage restoration.  Matt alleged this vendor (another defendant in the lawsuit) did not mitigate loss and damage and negligently damaged plaintiffs’ furniture, negligently refusing requests to exercise care in the restoration process.  The third defendant in the lawsuit was the agent who sold the policy to Matt’s clients. The agent was sued for negligent procurement of insurance.  Matt alleged the agent breached the duty of reasonable skill and diligence and failed to procure insurance coverage so that the insurer would pay full replacement cost for property damaged by fire. The insurance company was sued for breach of contract, bad faith and negligence/wantonness.  The restoration vendor was sued for negligence/wantonness.  

After extensive discovery and numerous depositions, Matt was able to settle the case to the satisfaction of his clients.  Ted Colquett, an attorney in Birmingham who has worked with Matt on several cases, referred the case to Matt.  Since the case was in Pickens County, Alabama, Matt associated Tim McCool in Carrollton to assist in the case.  Mr. McCool has also worked with Matt on numerous cases.  PGH is honored that the vast majority of its cases come from referring attorneys and previous clients.  It is a privilege to be able to work with other skillful attorneys all across the state.
