PGH partner, Bob Prince, settled a lawsuit in which his client was injured when an 18-wheeler repeatedly rear-ended her as she was stopped in traffic. Bob sued the trucking company alleging the company was vicariously liable because of the negligence and/or wantonness of its driver. He also sued his client’s insurance carrier claiming the trucking company was underinsured and therefore his client was owed underinsured motorist benefits under her policy of insurance. When the complaint was filed in the circuit court of Tuscaloosa County, Alabama, Bob also filed interrogatories and requests for production. He also took the deposition of the truck driver. After completing this discovery, the parties mediated the case. PGH associate Coe Baxter handled the mediation for the firm. At mediation, the parties were able to reach an agreement whereby all claims were settled.
